The Durban Magistrate’s Court denied a renewed bail application on Wednesday from two individuals implicated in the high-profile murders of rapper Kiernan “AKA” Forbes and Tebello “Tibz” Motsoane.

Mziwethemba Harvey Gwabeni and Lindokuhle Ndimande sought bail due to the financial and emotional challenges their families are facing because of their incarceration. They claimed that the State’s investigation had concluded, arguing there was no reason for their ongoing detention, and assured the court they would not interfere with witnesses.

Magistrate Vincent Hlatshwayo rejected their request, highlighting that there was no new evidence warranting bail.

Hlatshwayo commented, “The evidence submitted is not new. The first accused has a history of witness tampering, and there is insufficient indication that this behavior will not recur.”

Extradition and Related Allegations

The defendants also referenced the Ndimande brothers, Siyabonga Gezani and Malusi Dave, who are reportedly linked to the murders but are currently in Eswatini, resisting extradition to South Africa.

Gwabeni and Ndimande, along with Lindani Zenzele Ndimande, Siyanda Eddie Myeza, and Lindokuhle Lindo Ndimande, face multiple charges, including:

  • Conspiracy to commit murder
  • Murder
  • Unlawful possession of firearms and ammunition
  • Five counts of attempted murder
  • Money laundering

The State alleges Gwabeni orchestrated the murder scheme, receiving R800,000 and distributing the funds among his co-defendants.
